1. Who you're dealing with

The Site shop.cakepicnictour.com is operated by elisasunga LLC, a California limited liability company. "Cake Picnic", "we", "us", and "our" refer to elisasunga LLC. "You" refers to anyone who visits the Site, places an order, or attends a Cake Picnic event.

2. Accepting these terms

By using the Site or buying anything from us, you agree to these terms. If you don't agree, please don't use the Site.

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.

3. Orders, prices, and payment

• All prices are in US dollars unless otherwise stated. Prices and availability are subject to change without notice.
• We accept payment through Stripe (Visa, Mastercard, American Express, Discover), Apple Pay, Google Pay, and Link by Stripe.
• We reserve the right to refuse or cancel any order — including for suspected fraud, pricing errors, inventory issues, or violations of these terms. If we cancel an order you've already paid for, we'll refund you in full.
• Sales tax is added at checkout where required by law.

6. Event tickets

Cake Picnic event tickets are sold through Squarespace Commerce on cakepicnictour.com. Event terms — including the no-refund policy and the requirement to bring a qualifying cake — are set out in your ticket confirmation and on our FAQ.

Tickets are final sale, non-refundable, and non-transferable. Weather-related cancellations are handled per the event-specific terms you receive at purchase.

7. Intellectual property

"Cake Picnic" is a registered trademark of elisasunga LLC (USPTO Reg. SN 99129244). The Cake Picnic logo, brand marks, photography, and original Site content are owned by elisasunga LLC or licensed to us. You may not use any of it without our written permission.

The cookbook "The Cake Picnic Cookbook" is published by Chronicle Books and protected under separate copyright. Recipes are for personal, non-commercial use.

8. Acceptable use

You agree not to:

• Use the Site for any illegal purpose.
• Attempt to access accounts, data, or systems you don't own.
• Probe, scan, or test the security of the Site without permission.
• Scrape, mirror, or otherwise reproduce the Site at scale (manual personal use is fine).
• Send spam or unsolicited communications through any contact form, comment, or newsletter signup.
• Misrepresent yourself or your affiliation with us.

9. Third-party services

The Site uses third-party services (Stripe, Vercel, Squarespace, Resend, Klaviyo, Google Analytics, Gorgias, and shipping carriers). Their use of any information we share with them is governed by their own terms and privacy policies. We're not responsible for the content or practices of third-party sites linked from ours.

10. Disclaimers

The Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

We don't guarantee that the Site will be uninterrupted, secure, or error-free. Recipes and food-related content in our cookbook and on our Site are for educational and entertainment purposes. We are not responsible for allergic reactions, dietary outcomes, or food-safety issues that result from following our recipes.

11. Limitation of liability

To the maximum extent permitted by law, elisasunga LLC, its officers, managers, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total aggregate liability for any claim arising out of or relating to these terms or the Site is limited to the amount you paid us in the 12 months before the claim arose, or US $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless elisasunga LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these terms or your misuse of the Site.

13. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the Site will be resolved in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes means you accept the new terms.
